From the 70 reports mentioned above, a determination was made that a breach of FSMA may have occurred concerning 18 unauthorised firms and further assessments of each case were undertaken.
We can also confirm that, prior to the FCA taking up the regulation of the Funeral Plans Sector, a total of 738 consumer contacts were received by our Supervision Hub which made reference to ‘Funeral plans’. However, while we hold centralised records of all calls received by our Consumer Contact Centre, the details of those calls were not categorised in such a way that would allow us to easily identify any information relevant to your request.
In other words, to determine whether any of those calls contained intelligence suggestive of a potential breach of the RAO, we would need to review and analyse the full details of each individual record. We are of the view that this analysis and determination would be tantamount to creating new information, which we are not required to do under FOIA.
