1.  How many compliance cases were opened by you in the last five calendar years (ie. 2017,2018,2019,2020 and 2021).

2.  Of the compliance cases opened in each of those years, how many remain open and how many have been solved

Questions 1 and 2

Since 2017, 48 matters have been referred to case opening decision makers, for a decision on whether to open a regulatory enforcement case or to take alternative action. In relation to these 48 matters:

  • 9* enforcement cases have been opened (details of the enforcement cases we have opened are publicly available in our annual reports (2016/17, 2017/18, 2018/19, 2019/20, 2020/21).
  • 21 matters were referred for alternative action

For the remaining 17 matters, the decision of the case opening decision makers was to take no further action.

Please note that the figures above represent those matters referred for a case opening decision and therefore, matters which were closed down before reaching this stage are not captured in our response. Additionally, matters referred for alternative action, may be closed at later stage after further assessment.

*7 enforcement cases concerning the IFRs, 1 enforcement case concerning the PSRs and 1 enforcement case concerning General Direction 6 (GD6). Please note that in one of the IFR enforcement cases, the scope of the investigation was expanded to include an additional potential compliance failure, which was one of the 48 matters referred.
